The federal appeals court has upheld a ban on sending state troops in the Oregon city, following a recent legal decision.

Judicial Panel Concurs to Rehear Case

The federal appeals court ruled on this week that it would reexamine the legal dispute concerning the president’s authority with an expanded panel of 11 judges. The judicial body also overturned a earlier ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This order represents the most recent turn in a protracted court case over whether the administration has the authority and valid reason to deploy state military units in Portland. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was started in response to months of protests.

Conflicting Arguments

The federal government has claimed that government employees at the immigration center in south Portland were facing threats, while city and state officials maintain that local officers have control of the situation.

Contrary to characterizations of the city as a conflict zone, residents have been sharing footage of lush hiking trails and a thriving food scene, and planning activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland issued two temporary restraining orders this month – one preventing the federal control of the Oregon national guard, and another stopping the use of any national guard troops in the state, after attempts to evade the initial injunction by mobilizing troops from California.

On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, blocking the actual deployment of the forces.

The Tuesday decision means the matter will be heard by the full court – with all decisions under review together – by a group of 11 judges.

“This ruling demonstrates that facts are important and that the judicial system are working to hold this administration accountable. The founding document restricts the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a statement.

“The judicial body is sending a clear message: the executive leader cannot send the military into US cities unnecessarily. We will continue defending Oregon’s laws, principles, and autonomy as this case progresses and our legal battle continues in the courts.”
